Terms of Use Agreement for Minneapolis Pickleball Club (May 2024)
1. Acceptance of Terms
By becoming a member of the Minneapolis Pickleball Club (hereinafter referred to as "the Club"), you agree to abide by the following terms and conditions. These terms and conditions are legally binding and subject to change at the discretion of Club management. It is your responsibility to review and understand the most current version of these terms. Your continued use of the Club's facilities and services constitutes acceptance of any updated terms.
A membership pays for access to the building and the right to reserve the courts, register for open play and other events. All types of play or court usage require a reservation, which apart from your free open play or free court time will cost a fee on a per use basis
2. Pricing Structure

Founders Individual A includes 2 open play for $35/ month

Founders Dual A includes 4 open plays for $60/ month

Founders Individual B includes 2 free hours of court time per month for $75/ month

Founders Dual B includes 4 free hours of court time per month for $140/ month
5. Court reservations will cost $30 per hour during off peak hours (M-F 6 AM - 3PM) and $40 per hour during primetime.
6. Open play will cost $10 per session
3. Membership

To gain access to the Club's facilities, you must complete and have your membership application approved. Monthly fees and charges will be billed to your Club account.

Monthly fees and charges are subject to change, and members will be provided written notification prior to any fee adjustments.

Payment of fees and charges is not contingent upon facility availability. The Club may temporarily restrict access due to repairs, maintenance, government mandates, safety concerns, special programs, or events. Fees and charges will not be reduced or suspended during such periods.

Membership access is granted solely to the individual member and cannot be transferred or loaned to others.
4. Membership Hold

You may request to place your membership on hold by providing a 30-day written notice to the Club. During the hold period, you will lose access to the Club, and a holding fee of $10 per month will apply.

A membership can be placed on hold no more than twice in any given year for a maximum total of six months.
5. Booking Rules

A member can book a maximum of three courts in the same hour. Requests for four or more courts can be made by scheduling an event through the Club.
6. Termination of Membership

To terminate your membership, provide the Club with a 30-day written notice and return all access cards. Access cards must be returned to halt monthly fees. Applicable membership termination fees are listed in the membership agreement. Lost or unreturned cards will carry a $25 fee.

The Club reserves the right to terminate any member's membership for rule violations, nonpayment of fees, or improper conduct detrimental to the Club or its members. The member may be responsible for all fees and charges until access cards are returned.
7. Charges

Members agree to have club charges billed to their credit card, debit card, or EFT through their CourtReserve account. Unpaid fees will be calculated at the end of each month, and accounts unpaid for 10 days will be considered delinquent.

Late fees of $25 per month will apply to past-due accounts..

The primary payment method is Electronic Funds Transfer (EFT), debit card, or credit card. Membership dues are paid monthly. All court play is paid for at the time the reservation is made. Credit and debit card charges will include the card’s processing fee.

The club reserves the right to charge court time if members or their guests continue to play outside of their reserved/paid times. This is monitored through security cameras.
8. Operating Hours

Court hours are bookable between 6:00 AM to 11:00 PM with building access being from 5:45 AM to 11:15 PM seven days a week, year round.

The Club may close at times for maintenance, improvements, special events, or building emergencies. No membership refunds will be provided for these closures.
9. Guests

Only members have guest privileges.

Founders’ members receive unlimited free guests (no guest fees) through 12/20/24. Court fees and open-play fees will be required for all guests.

The member must accompany the guest throughout their stay and the guest must sign a liability waiver.

Failure to properly register a guest will result in guest fees being charged.

Guests must adhere to Club rules and policies.

The Non-Member Guest tool in CourtReserve is exclusively designated for either A. Members to facilitate the addition of their guests to court reservations, with the ability to share associated fees, or B. Members to enable their guests to autonomously register and pay for open plays. Any other usage or attempt to manipulate this tool for unauthorized purposes is strictly prohibited.

Non-Member Guests are restricted from accessing the facility independently and are only permitted to register for events when accompanied by a Member who extends the invitation. Non-Member Guests do not possess the inherent right to facility access or event registration without the direct involvement of a Member.

Any attempt to violate the outlined policies regarding Non-Member Guests may result in immediate termination of the individual's right to play at the club. The Club reserves the right to enforce these rules to maintain a fair and orderly use of its facilities and services.
10. Reservation and Cancellation Policies

Cancellations for lessons, clinics, special events, and private reservations must be made at least 24 hours in advance. Failure to provide sufficient notice may result in charges

Cancellations for open plays must be made at least 8 hours in advance. Failure to provide sufficient notice may result in charges.

Cancellations made with the appropriate 24-hour advance notice will receive a refund in the form of CourtReserve credit.

Private lessons not canceled with sufficient notice may incur charges at the instructor's discretion.

Reserved courts may be used by others if the reserving member does not arrive within 15 minutes of the scheduled start time.

11. Club Usage by Children

Parents must sign Club waiver forms for all children accessing the Club.

Parents are solely responsible for the safety and supervision of their children on Club premises.

The Club does not provide day care or childcare services.
12. Parking

Indoor free parking is available to all members while actively using the club facilities. Guests must park in the surface lot and are not entitled to indoor parking.

All members must park in the indoor garage to leave outdoor stalls for other tenants and guests.

No parking is available to members prior to and during U.S. Bank Stadium events as the stalls are rented. This is primarily for Vikings football games, of which there are 8-10 per year. Expect the lot to be full 2 hours before and after the start of the game.

Bike parking is available in the garage, which is secure and under surveillance. This can be accessed through the door immediately left of the main entrance.

13. Video Camera System

The Club utilizes a video security camera system for site monitoring. Live or recorded video feeds are reviewed daily by Club staff.

Security cameras are installed in non-private areas on the Club premises for security purposes. Video footage is recorded and stored digitally, but not permanently.

Cameras are not in areas with a reasonable expectation of privacy.

The security camera system is not actively live-monitored at all times, and members should contact emergency personnel in case of emergencies.

The Club is not liable for personal property loss or personal injury recorded on the security video system.
14. Building Security

1. 1200 Washington Ave South is a secured building. Access is granted only through key cards. It is the responsibility of every member and their guest to maintain this level of security. Do not let anyone into the building as you enter or exit. Failure to do so may result in termination of membership or financial responsibility for any damage to the building.
2. Members may not engage in protests, demonstrations, or any similar activities on the property of 1200 S Washington Ave where the club operates. Members are permitted to exercise their right to peaceful assembly on public sidewalks adjacent to the property.
3. In the event that a member is found participating in a protest on the property, their membership with Minneapolis Pickleball Club will be immediately revoked. Additionally, Any solicitation by members of other tenants in the building will result in immediate termination of their membership.
15. Miscellaneous

These terms are not exclusive, and other rules may be posted within the facility, binding as if set out herein.

Rules are subject to change without notice from Management.

All persons entering the Club must adhere to Club rules and policies.

By accepting these terms, you acknowledge and agree to abide by the rules and regulations outlined herein while using the Minneapolis Pickleball Club's facilities and services. Failure to comply may result in suspension or termination of membership.
